Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. APPLE INC. IS NOT A SPONSOR OF, OR RESPONSIBLE FOR CONDUCTING, THIS PROMOTION OR CONTEST.
ELIGIBILITY: Only legal residents of the fifty United States, D.C., Puerto Rico and Canada (other than Quebec), 18 years of age or older, are eligible to enter. Not open to employees, officers or directors --or to members of the immediate family or household of any of the foregoing --of American Standard Brands, Inc. (“Sponsor”), or any of its parents, subsidiaries, affiliates, or any advertising or promotion agencies or other persons involved in this Sweepstakes promotion (collectively, the “Sweepstakes Entities”). The Sweepstakes is void in Quebec, and wherever prohibited. Subject to all applicable laws.
SWEEPSTAKES PERIOD: The Responsible Bathroom Sweepstakes (the “Sweepstakes”) begins on March 19, 2010 at 12:00:01 am Eastern Time (“ET”) and ends on December 31, 2010 at 11:59:59 p.m. ET (the “Sweepstakes Period”). The Sponsor’s database computer is the official time-keeping device for the Sweepstakes.
HOW TO ENTER: There are two ways to enter.
Online. Visit www.theresponsiblebathroom.com (the “Website”), and follow the instructions to register on the Website with the information requested. You receive one entry into the Sweepstakes for registering. Registration and use of the Website are free. As part of the registration process, you will have the opportunity to elect whether to receive email or other communications from Sponsor about its products. Your decision whether to receive such messages does not affect your entry or your chance to win. After you are registered, you will have the opportunity to engage in various fun and informative activities on the Web Site relating to information about water conservation, including quizzes, viewing information about water-saving products from Sponsor, non-binding expressions of interest in such products, non-binding pledges to adopt certain water-savings practices of your own, and sharing information about your activities by email or by posting to certain social media pages. Each activity is worth a designated number of “points,” generally in the range of 1-10 points, all as detailed on the Website. Activities may be added, removed or modified from time to time during the Sweepstakes Period. For each 100 points you accumulate from free activities on the Website, you receive one (1) additional entry into the Sweepstakes. This is not a contest. You are not competing with others to accumulate the most points. The winners will be determined by random drawing as described below in these Official Rules.
By Mail. Hand print your name, complete street address, day and evening phone number, email address (if any), and date of birth on a 3” x 5” piece of paper, and mail your entry in an envelope with first-class postage to: “The Responsible Bathroom Sweepstakes, 200 Diversion, Suite 220, Rochester Hills, MI 48307. You may submit as many mail-in entries as you wish, but each entry must be mailed separately, postmarked by December 31, 2010, and received by January 10, 2011.
All entries become property of Sponsor. None will be acknowledged or returned. Any information you submit will be used for purposes of administering the Sweepstakes, and will be subject to the privacy policy posted on the Website. Limit one (1) online registration per person and per e-mail address. Subsequent registration attempts from the same person or email address will be disqualified. Any attempt by a person to register on the Website more than once, with multiple email accounts or otherwise, may result in disqualification at the discretion of the Sponsor.
SELECTION OF WINNERS: There are two different opportunities to win in the Sweepstakes:
Weekly Drawings. For each week during the Sweepstakes Period, a drawing will be held to award one (1) weekly prize for the applicable week. A “week” is defined as the period beginning at 12:00:01 a.m. ET on a Sunday, and ending at 11:59:59 p.m. ET on a Saturday during the Sweepstakes period. Each weekly drawing will be held approximately ten (10) days after the end of the applicable week. The first week of the Sweepstakes ends Saturday, March 27, 2010, and the last week ends on December 31, 2010. The winner in each weekly drawing will be selected at random from among all eligible online entries received by the end of the applicable week plus all mail-in entries that were postmarked by the end of the applicable week and received by the time of the weekly drawing. Proof of transmission is not proof of receipt. All non-winning entries in each weekly drawing remain eligible for all subsequent weekly drawings.
Grand Prize Drawing. One (1) Grand Prize winner will be selected at random, on or about January 14, 2011, from among all eligible entries received throughout the Sweepstakes Period.
All winners will be selected by an independent judging organization, whose decisions are final and binding. Each potential winner will be notified by telephone and/or mail and/or email using the contact information given at the time of entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If a potential winner does not respond within 10 days after the first notification attempt, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner may be disqualified and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected.
PRIZES/ODDS: One (1) Grand Prize: Winners’ choice among the following three trips, each good for up to 4 people: (a) A six-night, seven-day Costa Rica Adventure, Approximate Retail Value (“ARV”) $15,000.00; (b) An eight-day, seven-night Idaho White Water Adventure, ARV $13,000.00, or (c) A seven-day, six-night Maho Bay St. John Virgin Islands trip, ARV $9,000. Thirty Nine Weekly Prizes: An American Standard Brand FloWise Shower Head, ARV $68.00 each.
Odds of winning a Weekly Prize depend on the number of eligible entries received as of the cut-off date for the applicable week’s drawing per the preceding Rule (“Selection of Winners”). Odds of wining Grand Prize depend on total number of eligible entries received throughout the Sweepstakes Period. Sweepstakes is open to over 100,000,000 million internet users and others in the United States and Canada.
GRAND PRIZE TRIP CONDITIONS: Each trip prize option consists of the following: Round-trip coach air transportation for winner and his/her guest(s) between selected destination and major airport nearest winner’s residence as determined by Sponsor in its sole discretion; the designated number of days/nights standard hotel accommodations for up to 4 people (based on double occupancy); some meals and activities as determined by sponsor in its discretion, and $500 cash. All travel arrangements must be made through agents/suppliers designated by Sponsor. All travel dates and accommodations are subject to availability. Some blackout days may apply. Winner and any travel guest(s) must have all necessary documentation for travel, including but not limited to valid passport if required. Each travel guest must sign and return a liability and/or publicity releases prior to issuance of travel documents. Winner and travel companion(s) must book and travel on same itinerary. All travel must be completed by December 31st, 2011, or prize will be forfeited. Sponsor will not replace any lost, mutilated, or stolen travel vouchers or certificates. The total value of any trip prize cannot exceed the value of for that trip as designated in these Official Rules. Actual value at time of booking and travel may be vary depending on dates of travel, point of origin, ticket availability, and number of guests to accompany the Winner. In the event a Winner lives within a 200-mile radius of the prize destination, Sponsor may provide Winner with round trip ground transportation between Winner’s residence and destination, in lieu of the round trip coach air transportation. No cash award will be made for any difference in value between the amount listed in these Rules and the actual trip selected/taken by Winner, including if winner chooses to travel with fewer than the maximum allowed number of guests. Any travel companion who is a minor under the laws of his/her state of residence must be accompanied on trip by a parent or legal guardian. No additional travel expenses or any other aspects of the travel related prizes will be awarded should any guest’s parent or legal guardian be required to accompany guest on trip. Winner and his/her guest(s) will be solely responsible for all expenses associated with the trip not expressly listed in these Official Rules, including but not limited to tips, gratuities, service charges, taxes, meals not included in the initial itinerary, ground transportation not specified, hotel room service, laundry service, alcoholic beverages, merchandise, souvenirs, local and long-distance telephone calls, port charges, and any other incidental costs or expenses not identified in these Official Rules. Major credit card may be required at time of hotel check-in to cover incidental expenses.
GENERAL PRIZE CONDITIONS: Winners are responsible for all federal, state and/or local taxes, and for any other fees or costs associated with acceptance or use of any prize not expressly included in these Official Rules. Each potential winner may be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release (collectively, “Prize Claim Documents”). Failure to comply when requested may result in disqualification and selection of an alternate winner. If a winner is not of legal age of majority in his or her state of residence (a “minor”), at Sponsor’s option, the applicable prize either may be awarded in the name of parent or legal guardian of winner, or parent or legal guardian of winner may be required to ratify and sign all Prize Claim Documents. No cash alternative or prize substitutions will be allowed, except in Sponsor’s discretion; Sponsor may award a substitute of comparable or greater value if any prize listed becomes unavailable for any reason.
GENERAL PROVISIONS: By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of the judges and Sponsor, which shall be final and binding in all respects. Acceptance of a prize constitutes winner’s permission for Sponsor to use winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation except where prohibited by law. Entrants (and any minor entrant’s parent or legal guardian) agree that the Sweepstakes Entities (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.
Sponsor assumes no responsibility for any damage to an entrant’s computer system which is occasioned by accessing the Website or otherwise participating in the Sweepstakes, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information.
Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted.
In the event of a dispute as to the identity of the entrant, any on-line entry will be deemed submitted by the authorized account holder of the e-mail account from which it was sent, provided such account holder must still meet the eligibility requirements for the Sweepstakes. The authorized account holder shall be the natural person to whom the applicable email address has been assigned by the Internet access provider, service provider, or other online organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winners in a random drawing from all eligible, non-suspect entries unaffected by the problem. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
Only the type and quantity of prizes described in these Official Rules will be awarded. If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
WINNERS LIST/OFFICIAL SWEEPSTAKES RULES REQUEST: For the names and city/state of residence of Prize winners, or a copy of these Official Rules, send a request specifying a copy of the Winners' List or Official Rules along with a self-addressed, stamped envelope to: VFI/American Standard “The Responsible Bathroom” Winners List, 106 Elm St, Stonington, CT 06378. VT and WA residents may omit return postage for Official Rules requests. Requests must be received by February 15, 2011.
